Gerald F. Ivey

Gerald F. Ivey is a seasoned patent litigator and trial attorney with extensive experience concentrating on jury trial patent cases, including lead counsel roles in federal district courts and appearances before the U.S. Court of Appeals for the Federal Circuit. He is a partner at Finnegan, Henderson, Farabow, Garrett & Dunner, where he has practiced throughout his tracked patent litigation career. Ivey's practice spans a broad range of technologies, including Internet, computer software and hardware, semiconductors, optical character recognition, voice recognition technology, biotechnology, medical devices, and mechanical products. He also handles trade secrets litigation and counseling.

Ivey has demonstrated a balanced practice, representing both plaintiffs and defendants in high-stakes patent disputes. His tracked cases show a slight leaning toward defendant-side work (5 defendant, 4 plaintiff appearances). Notable defense victories include securing a complete defense jury verdict for ABBYY and Lexmark in a patent and trade dress case involving optical character recognition, where the client was found not liable for $260 million in alleged damages, a verdict later affirmed by the Federal Circuit. He also successfully defended Volkswagen, Audi, Bentley, and Lamborghini against patent infringement allegations concerning power electronics and semiconductor structures at the International Trade Commission (ITC) and in the Eastern District of Texas. Additionally, Ivey was part of the Finnegan team that secured a jury trial victory for FedEx in a case against Intellectual Ventures II LLC.

On the plaintiff side, Ivey acted as lead trial counsel for Promptu Systems Corporation, obtaining a significant $240 million jury verdict against Comcast in a patent infringement lawsuit involving voice recognition technology. This complex litigation involved successfully navigating eight failed PTAB challenges by Comcast and a favorable Federal Circuit appeal that corrected restrictive claim constructions before the case proceeded to trial. His experience further includes representing Shure Incorporated in a dispute over utility and design patents for ceiling microphone array products, which settled favorably after trial. Ivey is also currently involved in representing Samsung Electronics Co., Ltd. in ongoing patent litigation brought by W&Wsens Devices Inc. involving semiconductor technology, a case with related PTAB proceedings. His involvement in the Promptu case defending patents against multiple PTAB challenges, and the W&Wsens case involving active PTAB actions, demonstrates experience with post-grant review proceedings.
