Gary M. Fox

Gary M. Fox is an attorney at Wilmer Cutler Pickering Hale and Dorr LLP, where he focuses his practice on complex patent litigation, particularly appeals before the US Court of Appeals for the Federal Circuit. He is a member of the firm's Appellate and Supreme Court Litigation group, often handling cases involving novel procedural issues arising from post-grant proceedings at the US Patent and Trademark Office (PTAB). His experience spans diverse technology areas, including balloon catheters, content delivery networks, pharmaceutical dosing regimens, and power amplifiers for mobile devices.

Mr. Fox primarily represents defendants and appellants in patent disputes. His work includes defending against patent assertions and appealing adverse decisions. For example, he served as counsel for Palo Alto Networks, Inc. in Centripetal Networks, LLC v. Palo Alto Networks, Inc. et al.. He also notably helped defend Akamai Technologies' district court victory on appeal in Akamai Technologies, Inc. v. MediaPointe, Inc. (Fed. Cir. 2025), where the Federal Circuit affirmed rulings on indefiniteness and non-infringement.

His experience extends significantly to PTAB and IPR proceedings, where he has been a principal drafter for Intel in consolidated appeals from six inter partes reviews in Qualcomm Inc. v. Intel Corp. (Fed. Cir. 2024). He also secured the reversal of a Board decision canceling his client's patent claims in Speck v. Bates (Fed. Cir. 2024), resulting in a precedential opinion on a statutory time bar.

Mr. Fox is admitted to practice in New York and the District of Columbia, as well as before the US Supreme Court, the US Court of Appeals for the Federal Circuit, and the US Patent and Trademark Office. He previously clerked for the Honorable Richard G. Taranto of the US Court of Appeals for the Federal Circuit and the Honorable Leonard P. Stark of the US District Court for the District of Delaware.
