Frank M. Gasparo

Frank M. Gasparo is a highly experienced patent litigator and a co-chair of Venable LLP's Intellectual Property (IP) Litigation - Technology Group, as well as a member of the firm's board of directors. His practice spans patent, trademark, and trade secret disputes, with a strong focus on technology. He regularly handles complex matters involving electronics, computer hardware and software, media, entertainment, luxury and consumer goods, financial products and services, and telecommunications, including adaptive video streaming technology.

Mr. Gasparo represents both plaintiffs and defendants, demonstrating a versatile practice in intellectual property litigation. His tracked case history shows him acting as lead counsel for plaintiffs in two matters and for defendants in one, including engagements for both Aylo Freesites Ltd. and DISH Technologies L.L.C. in their related patent disputes. Venable's IP Litigation Technology Group emphasizes its capability in representing both rights holders and accused infringers across various industries.

A significant portion of his work includes the ongoing multinational patent disputes between Aylo Freesites Ltd. and DISH Technologies L.L.C., centered on adaptive video streaming technology. In related proceedings, an infringement suit brought by DISH was dismissed by the Munich Regional Court, and a patent asserted by DISH was revoked by the Unified Patent Court (UPC) Central Division Paris in May 2025, where Mr. Gasparo represented Aylo. Furthermore, in an Inter Partes Review (IPR) initiated by Aylo against DISH Technologies LLC, the Patent Trial and Appeal Board (PTAB) found certain patent claims to be unpatentable, a decision DISH subsequently appealed to the Federal Circuit. He has been lead counsel in several post-grant proceedings under the America Invents Act (AIA), showcasing extensive PTAB and IPR experience. He has litigated in U.S. courts, the UK, Germany, the UPC, and before the International Trade Commission (ITC).

Mr. Gasparo earned his J.D., with honors, from Brooklyn Law School in 1998 and a B.E.E., cum laude, from the State University of New York at Stony Brook in 1995. He is admitted to practice in New York and Connecticut, and before the U.S. Patent and Trademark Office, the U.S. Supreme Court, and the U.S. District Courts for the Southern and Eastern Districts of New York. He joined Venable LLP in March 2011 from Baker & McKenzie LLP, where he was also a partner.
