Eric J. Rutt

Eric J. Rutt is a Shareholder in the Litigation practice group at Wolf Greenfield, where he focuses on patent and trade secret litigation. His practice encompasses all phases of litigation, from pre-suit investigation through trial and appeal, and he regularly appears in federal district courts across the United States.

Mr. Rutt handles a broad spectrum of technologies, including computer systems, software, DNA diagnostics, biologics, chemicals, transgenic seeds, dental prosthetics, medical devices, and consumer products. While his tracked appearances show one instance on the plaintiff side, his professional profile indicates experience representing both patent owners in infringement suits and defendants accused of patent infringement. Notable representations include securing a jury verdict finding patents infringed and not invalid for a cancer diagnostics company in ArcherDX v. Qiagen (D. Del.), and successfully defending Kantar and WPP against patent infringement and trade secret claims in TiVo v. Kantar/WPP (S.D.N.Y.), where he secured dismissal of claims at summary judgment.

He also possesses extensive experience in post-grant proceedings before the Patent Trial and Appeal Board (PTAB). Mr. Rutt has secured denials of institution in multiple Inter Partes Review (IPR) proceedings for patent owners, including in the ongoing LiTL v. HP, Dell, ASUSTeK and the favorably settled LiTL v. Lenovo matters. He has also successfully represented petitioners, securing a Final Written Decision invalidating all challenged claims of a patent to transgenic seeds.

Mr. Rutt earned his J.D., cum laude, from Boston College Law School and his B.S. in Chemistry, magna cum laude, from Eastern Mennonite University. He is admitted to practice in Massachusetts, the U.S. District Court for the District of Massachusetts, and the U.S. Court of Appeals for the Ninth Circuit.
