Eric A. Caligiuri

Eric A. Caligiuri is an experienced intellectual property attorney at Weintraub Tobin Chediak Coleman Grodin, where he serves as Of Counsel. His practice primarily focuses on complex patent and trade secret litigation in federal district courts, California state courts, and before the U.S. International Trade Commission (ITC). Mr. Caligiuri also handles patent and trademark prosecution before the U.S. Patent and Trademark Office (USPTO). His technology experience spans a wide array of fields, including optical communications, semiconductor products and processes, mobile device components, networking, Wi-Fi enabled devices, electronics, wireless communication protocols, software, biotechnology, pharmaceuticals, medical devices, and mechanical systems.

Caligiuri maintains a balanced litigation practice, having represented clients as both plaintiff and defendant in patent disputes. His experience includes working with companies seeking to enforce their intellectual property rights and defending operating companies against infringement allegations.

Notable cases include his representation of Applied Optoelectronics, Inc. in patent infringement lawsuits. For instance, in November 2024, he represented Applied Optoelectronics, Inc. in a patent infringement complaint filed against Eoptolink Technology USA Inc. in the U.S. District Court for the Northern District of California, involving optical transceiver patents. He also represented Applied Optoelectronics, Inc. as Patent Owner in CAMBRIDGE INDUSTRIES USA, INC. et al. v. Applied Optoelectronics Inc., where Cambridge Industries filed several Inter Partes Review (IPR) petitions against Applied Optoelectronics' optical module patents. The Patent Trial and Appeal Board (PTAB) denied institution for some of these IPRs in June 2025, a favorable outcome for his client.

His PTAB experience extends to authoring articles on proposed changes to IPR and Post-Grant Review (PGR) proceedings, demonstrating a current understanding of administrative patent law. Caligiuri was admitted to the State Bar of California in 2008 and earned his law degree from the University of San Diego School of Law.
