Emily Gabranski

Emily Gabranski is a patent litigation attorney at Finnegan, Henderson, Farabow, Garrett & Dunner, with a practice primarily focused on complex patent and trade secret litigation in the biotechnology, biologics, and pharmaceutical fields. She handles a wide range of technologies including small molecule pharmaceuticals, therapeutic antibodies, inorganic chemistry, semiconductors, and gene therapies. Her experience encompasses all phases of pre-litigation and litigation, as well as counseling and diligence matters.

Gabranski predominantly represents defendants. In her tracked case, Genzyme Corporation v. Novartis Gene Therapies, Inc., she served as lead counsel, successfully defending Novartis against multiple patent infringement actions and inter partes review (IPR) proceedings concerning recombinant adeno-associated virus vector technology used in gene therapy. This high-stakes litigation, targeting Novartis's Zolgensma® gene therapy, settled after several patents were invalidated during claim construction, others found not literally infringed, and multiple IPRs were instituted. The case concluded with a dismissal with prejudice, where each party bore its own costs. She also represented American Regent in litigation related to iron carbohydrate complexes, which resulted in a favorable settlement.

Her practice also includes significant experience with post-grant proceedings before the Patent Trial and Appeal Board (PTAB) of the U.S. Patent and Trademark Office (USPTO), including inter partes reviews (IPRs). She has been part of teams representing clients in multiple IPR proceedings, such as those involving antibody therapies for Eli Lilly. She has co-authored articles discussing the ramifications of PTAB decisions, indicating a depth of involvement in this area.

Emily Gabranski earned her B.A. in neuroscience, with honors, from Bowdoin College in 2009 and her J.D. from Vanderbilt University in 2015. She was admitted to practice in Washington, DC, in 2016. Prior to her legal career, she conducted research in cellular and molecular neurobiology. She has been recognized on the Best Lawyers "Ones to Watch" list for multiple years.
