Elana B. Araj

Elana B. Araj is a patent litigation attorney at Greenberg Traurig, LLP, where she serves as Counsel. Her practice encompasses patent, trademark, and copyright infringement litigation in U.S. district courts, as well as post-grant review proceedings before the U.S. Patent & Trademark Office. She counsels clients across diverse industries, including consumer products, health care, medical devices, and software technologies, and also provides advice on patentability, freedom-to-operate analyses, and patent prosecution.

Ms. Araj has experience representing both plaintiffs and defendants in patent disputes. Her tracked experience includes representing Aerin Medical Inc. as plaintiff in Aerin Medical Inc. v. Neurent Medical Ltd. et al., a case involving medical devices for treating nasal airways. She was also part of the Greenberg Traurig team that secured a complete victory for defendants The Charles Schwab Corporation and TD Ameritrade, Inc. in Island Intellectual Property LLC v. The Charles Schwab Corporation and TD Ameritrade, Inc., where the Federal Circuit affirmed the invalidity of the asserted patents. Additionally, she was involved in IN RE: TELEBRANDS CORPORATION (2016) at the Federal Circuit, concerning a patent for a water balloon product.

Her experience extends to inter partes review (IPR) proceedings. She focuses her practice on post-grant review, and the Aerin Medical litigation also involved multiple IPR challenges related to the asserted patents. Before entering private practice, Ms. Araj served for four years as a patent examiner with the United States Patent and Trademark Office.
