Specialty & background
E. Joshua Rosenkranz is a preeminent appellate litigator and the head of Orrick, Herrington & Sutcliffe's Supreme Court & Appellate practice. His work in patent litigation is a component of a broader practice handling high-stakes appeals across various legal disciplines, including intellectual property, antitrust, and constitutional law. Rosenkranz specializes in representing clients before federal and state appellate courts, including the U.S. Supreme Court, where he has argued more than 20 times. His intellectual property practice often involves complex technology, as seen in his representation of Oracle against Google in a landmark Supreme Court software copyright case and his work for DISH Network, successfully overturning a patent injunction that threatened the company.
Consistently representing major operating companies, Rosenkranz has a clear record of defending clients against significant adverse judgments. He is widely known for securing reversals of massive verdicts on appeal, earning him the nickname "the Defibrillator". His notable IP-related work includes representing Sonos in its patent appeal against Google and Oracle in its multi-billion dollar copyright dispute with Google. He has also led the charge in overturning a $1 billion copyright verdict for Cox Communications and a $2 billion trade secrets verdict against Pegasystems.
Mr. Rosenkranz has been a partner at Orrick for the majority of his recent career. He previously practiced at Heller Ehrman and was the founding president and CEO of the Brennan Center for Justice at NYU School of Law. While his practice focuses on appeals from district court and, in some instances, the Patent Trial and Appeal Board—such as his Supreme Court argument in Cuozzo Speed Technologies v. Lee which concerned IPR proceedings—the public record does not indicate he regularly litigates directly before the PTAB.
He is a graduate of Georgetown University Law Center and previously clerked for Justice William J. Brennan Jr. of the U.S. Supreme Court and then-Judge Antonin Scalia of the U.S. Court of Appeals for the D.C. Circuit.
