He has secured favorable outcomes for clients in significant cases, including a jury verdict of patent invalidity for Google and YouTube against the University of California and Eolas, defeating claims for hundreds of millions in damages over patents related to interactive web pages. Lumish also achieved a summary judgment win for Amazon against Telebuyer and for Meta (WhatsApp) against TriPlay. For Symantec Corp., he obtained a jury verdict of non-infringement on a key patent, eliminating substantial damages risk, and later had the remaining patents invalidated on appeal to the Federal Circuit. He has also been involved in ITC and Customs actions, notably for Arista Networks against Cisco Systems, and for AbbVie in trade secret disputes related to biosimilars. Lumish regularly appears in federal trial and appellate courts, and before the International Trade Commission (ITC). He is also active in PTAB procedures, including IPRs and covered business method review proceedings.
Lumish earned his J.D. from Santa Clara University School of Law in 1996 and was admitted to the State Bar of California in December 1996. Prior to law school, he worked as a systems consultant to technology companies.
