Douglas E. Lumish

Douglas E. Lumish is a highly experienced patent litigator with a focus on high-stakes intellectual property, technology, and life sciences litigation. His practice encompasses patent, trade secret, contract, licensing, and other technology-related cases. He has extensive experience in technologies spanning high-tech, biotechnology, life sciences, software, hardware, and artificial intelligence. Lumish is recognized for his ability to explain complex technological concepts to juries.

Throughout his career, Lumish has primarily represented defendants, including numerous Fortune 500 technology and life sciences companies. His tracked appearances show him acting as lead counsel for defendants in Intent IQ, LLC v. MNTN, Inc. and VB Assets, LLC v. Amazon.com, Inc. et al.. He has also served as lead counsel for a plaintiff in an untitled case.

Lumish recently returned to Weil, Gotshal & Manges LLP as Co-Head of the firm's nationwide IP, Technology & Science Litigation practice, where he initially began his legal career in 1996. Prior to rejoining Weil in 2025, he spent 12 years at Latham & Watkins, where he held leadership roles including Global Vice Chair of the Litigation and Trial Department, Global Co-Chair of its IP Litigation practice, and Co-Chair of the firm's Bay Area Litigation and Trial Department. He also previously led the IP practice group at Kasowitz, Benson, Torres & Friedman.

He has secured favorable outcomes for clients in significant cases, including a jury verdict of patent invalidity for Google and YouTube against the University of California and Eolas, defeating claims for hundreds of millions in damages over patents related to interactive web pages. Lumish also achieved a summary judgment win for Amazon against Telebuyer and for Meta (WhatsApp) against TriPlay. For Symantec Corp., he obtained a jury verdict of non-infringement on a key patent, eliminating substantial damages risk, and later had the remaining patents invalidated on appeal to the Federal Circuit. He has also been involved in ITC and Customs actions, notably for Arista Networks against Cisco Systems, and for AbbVie in trade secret disputes related to biosimilars. Lumish regularly appears in federal trial and appellate courts, and before the International Trade Commission (ITC). He is also active in PTAB procedures, including IPRs and covered business method review proceedings.

Lumish earned his J.D. from Santa Clara University School of Law in 1996 and was admitted to the State Bar of California in December 1996. Prior to law school, he worked as a systems consultant to technology companies.
