Dominick A. Conde

Dominick A. Conde is a seasoned patent litigator with a practice primarily focused on representing pharmaceutical and life sciences companies in high-value patent disputes. His specialty lies in Hatch-Waxman and Abbreviated New Drug Application (ANDA) litigation, a focus underscored by his frequent representation of branded pharmaceutical clients against generic manufacturers. Beyond pharmaceuticals, Mr. Conde's experience extends to other technology areas, including biotechnology, chemicals, consumer goods, energy, industrial equipment and manufacturing, and medical devices, drawing on his background in mechanical engineering.

Throughout his career, Mr. Conde has predominantly represented patent holders and plaintiffs. His tracked appearances reflect four plaintiff-side engagements, and his professional profile highlights numerous instances of acting for branded pharmaceutical companies in patent enforcement actions against generic competitors. He currently serves as co-chair of the Intellectual Property Division at Venable LLP, having previously been chair and managing partner at Fitzpatrick, Cella, Harper & Scinto.

Mr. Conde has been lead counsel in significant patent litigation matters, including cases for Astellas Pharma Inc. against multiple generic companies such as Hikma Pharmaceuticals USA Inc., Haimen Pharma Inc., Zydus Pharmaceuticals (USA) Inc., and Ascent Pharmaceuticals, Inc. A notable engagement included representing Astellas, Pfizer, and the University of California in litigation covering the prostate cancer drug Xtandi® against numerous defendants. He was also counsel for Nalpropion Pharmaceuticals LLC in a Supreme Court petition denial and argued for plaintiffs-appellees in Insite Vision, Inc. v. Sandoz, Inc. before the Federal Circuit. Venable, with Mr. Conde recognized as a Life Sciences Star for his work, received the Hatch-Waxman Impact Case of the Year Award for its involvement in Novartis Pharmaceuticals et al. v. Breckenridge Pharmaceutical et al.

In addition to district court litigation, Mr. Conde regularly represents clients in contested proceedings before the U.S. Patent and Trademark Office. He earned his J.D. from Franklin Pierce Law Center in 1990 and holds a B.S. in Mechanical Engineering from Rensselaer Polytechnic Institute (1982). He is admitted to the New York bar and registered to practice before the U.S. Patent and Trademark Office, with admissions to several U.S. District Courts, the U.S. Court of Appeals for the Federal Circuit, and the U.S. Supreme Court.
