Dion M. Bregman

Dion M. Bregman is a highly experienced patent litigator and intellectual property attorney, currently a partner at Morgan, Lewis & Bockius LLP, where he is the deputy leader of the firm's intellectual property practice and co-leader of its Patent Trial and Appeal Board (PTAB) group. He joined Morgan Lewis in 2004, having previously practiced intellectual property law at firms in New York and South Africa.

Mr. Bregman's practice spans a wide array of technology areas, representing public and private companies across diverse industries. His expertise includes software, hardware, user interfaces, media, internet, telecommunications, medical devices, aerospace, business methods, fintech, semiconductors, healthcare, and electric and autonomous vehicles, with a particular focus on AI-related technologies. His case experience includes disputes related to modular tool systems, as seen in Klein Tools, Inc. v. Milwaukee Electric Tool Corporation et al., and laser systems for tissue therapy in Candela Corporation et al. v. Nikolai Tankovich.

While he has represented both petitioners and patent owners in post-grant proceedings, his tracked litigation appearances indicate a primary focus on defending operating companies. Notably, Mr. Bregman was instrumental in securing a $140 million victory for the plaintiff in ActiveVideo v. Verizon, an outcome with a total expected recovery exceeding $260 million. In PTAB proceedings, he recently represented Milwaukee Electric Tool Corporation as Patent Owner in Klein Tools, Inc. v. Milwaukee Electric Tool Corporation et al. (IPR2024-01400, IPR2024-01401), where the USPTO Director granted review and denied institution of inter partes review. He also represented Patent Owner Nikolai Tankovich in Candela Corporation et al. v. Nikolai Tankovich (IPR2023-00234), where the patent was found patentable following a final written decision, now under appeal.

Mr. Bregman possesses extensive experience in PTAB trials, having successfully led over 165 proceedings and having argued the second-ever IPR before the PTAB. He maintains an active litigation practice, complemented by significant experience in patent prosecution, counseling, and managing extensive patent portfolios for Fortune 500 companies and startups. Admitted to the California Bar in 1998, he earned his LL.B. (J.D.) from the University of Johannesburg, South Africa, in 1998 and a B.S.C. in Aeronautical Engineering from the University of the Witwatersrand, South Africa, in 1993.
