David S. Almeling

David S. Almeling is a highly regarded intellectual property litigator with a focus on patent and trade secret disputes, currently a Partner and Chair of the Trade Secret Group at O'Melveny & Myers LLP in San Francisco. His patent litigation practice primarily involves defending operating companies in complex technology disputes, reflecting a consistent defendant-side orientation as seen in his tracked appearances. Prior to O'Melveny & Myers, he was also associated with Fenwick & West, where he represented defendants in patent matters.

Mr. Almeling's practice encompasses a range of technology sectors, including software, cloud computing, and electronics. Notable patent litigation experience includes defending a multinational public cloud computing company against over three dozen patent matters, achieving an across-the-board victory with verdicts of invalidity and noninfringement in a case involving terrain visualization software where the plaintiff sought over $100 million in damages. He has also successfully defended a leading provider of video-streaming services in patent cases, resulting in favorable resolutions with no monetary payment from the client.

He possesses substantial experience in post-grant proceedings before the U.S. Patent & Trademark Office, including dozens of ex parte and inter partes reexaminations, Inter Partes Review (IPR) proceedings, and Covered Business Method (CBM) proceedings, and has served as first chair at several IPR hearings.

Mr. Almeling earned his B.A. with highest honors from the University of Florida, where he was Valedictorian, and his J.D. with high honors from Duke University School of Law, where he was a member of the Order of the Coif. He was admitted to the State Bar of California on January 10, 2005.
