David Michael Hoffman

David Michael Hoffman is a Principal at Fish & Richardson P.C., focusing his practice on patent litigation, inter partes review (IPR) proceedings, and broader intellectual property counseling. He is based in Austin, Texas, and has developed a reputation as a go-to authority in the Western District of Texas for patent infringement litigation.

Mr. Hoffman primarily represents defendants, with all two of his tracked appearances on the defense side. His experience extends across a range of electrical and mechanical technologies, including semiconductors, memory, software, and wireless communications, with a particular emphasis on technology and software clients. He also provides counsel on matters related to standard essential patents. His client representations include major corporations in diverse industries, encompassing areas such as flash memory card readers, processor design, lithium-ion batteries, and remote medical monitoring.

Notable engagements include securing a finding of non-infringement for Kingston against TPL in an International Trade Commission (ITC) suit involving flash memory card readers. He also represented a multinational technology company in a patent infringement suit concerning processor operation and design, which settled favorably. In a significant PTAB success, Mr. Hoffman secured an IPR win for The Heil Co. where the Board found a patent covering a sanitation system invalid. He is also lead counsel for FedEx Corporation in the ongoing case Valtrus Innovations Ltd. et al. v. FedEx Corporation et al., where his client has pursued IPRs against Valtrus Innovations Ltd.

Mr. Hoffman possesses extensive experience before the Patent Trial and Appeal Board (PTAB), having appeared in more than 60 IPR proceedings. He is admitted to practice in Texas, where he has been licensed since 2004. He earned his J.D. from the University of Texas Law School in 2004, and holds a B.S. in Electrical Engineering and a B.A. in Plan II Liberal Arts Honors, both from the University of Texas at Austin, in 1997.
