David Bluestone

David Bluestone is a patent litigator at Benesch, Friedlander, Coplan & Aronoff LLP, where he focuses on electrical, mechanical, and software technology matters. With 25 years of experience, his practice encompasses patent litigation, intellectual property licensing, evaluation, and procurement. He represents a diverse client base ranging from large market capitalization companies to small privately-held entities across various industries.

Mr. Bluestone handles both plaintiff and defense-side patent litigation. He has secured complete wins for technology companies enforcing their rights against competitors and non-practicing entities. His notable achievements include winning a patent infringement trial with willful infringement and double damages for valve technology, obtaining a complete defensive win resulting in non-infringement, invalidity, and unenforceability in a cellular telephone technology patent case (Motorola v. Vosi), and successfully arguing claim construction leading to a settlement for a market-leading hearing instrument manufacturer. He also won summary judgment of infringement for patents protecting the iconic Aeron chair.

His experience extends to inter partes review (IPR) proceedings before the USPTO, where he has argued before the Patent Trial and Appeal Board (PTAB). Mr. Bluestone has litigated in multiple United States District Courts, the Court of Appeals for the Federal Circuit, and the United States Supreme Court, and is a member of the Trial Bar of the United States District Court for the Northern District of Illinois.

Mr. Bluestone became registered to practice before the USPTO while in law school. Prior to joining Benesch, he was affiliated with Barack Ferrazzano Kirschbaum & Nagelberg.
