Specialty & background

Daniel Scardino is a seasoned patent litigator with a practice emphasizing intellectual property disputes in federal court. His expertise spans diverse technology areas, including wireless data communications, interactive media, display technology, software, and oil and gas innovations. Scardino primarily represents patent owners, with his tracked appearances reflecting a plaintiff-side focus. He has secured substantial recoveries for his clients, totaling over $150 million.

Scardino currently serves as a Partner at Scardino LLP, which he co-founded in 2018. Prior to establishing his current firm, he was the Managing Partner of Reed & Scardino, LLP from 2010 to 2018, and a Partner at Jackson Walker L.L.P. from 2001 to 2010. Among his notable achievements, Scardino acted as lead counsel in multi-jurisdictional patent infringement litigation concerning pioneering wireless data communications technology, securing a favorable jury verdict against Apple and numerous licenses totaling approximately $75 million. This included a nearly $25 million jury verdict against Apple in 2014. He also represented Mobile Telecommunications Technologies LLC in a settled patent infringement suit against T-Mobile USA Inc., involving wireless network technology.

His work includes representing Phenix Longhorn, LLC as lead counsel in a patent infringement case against Innolux Corporation, involving display technology patents. This case concluded with a stipulated voluntary dismissal, following an undisclosed negotiated resolution which included Innolux paying $3.825 million based on an effective royalty rate for relevant products. Scardino also served as co-counsel in Performance Chemical Company v. True Chemical Solutions, LLC, where case-determinative sanctions for spoliation of evidence resulted in findings of willful infringement, a permanent injunction, and an award of attorneys' fees, leaving only damages for trial. His experience extends to PTAB proceedings, having appeared as counsel for a patent owner in an Inter Partes Review (IPR) and advocating for discretionary denial of institution in other IPRs based on parallel district court litigation.

Scardino is admitted to the State Bar of Texas and is licensed to practice before the U.S. Supreme Court, the U.S. Courts of Appeals for the Fifth and Federal Circuits, and all U.S. District Courts in Texas. He earned his J.D. from Tulane Law School in 2001 and a B.A. in History from Emory University in 1998.
