Daniel Gonzalez

Daniel Gonzalez, Jr. is an intellectual property litigation attorney with a primary focus on the biotechnology, life sciences, and pharmaceutical sectors. His practice centers on patent disputes, often involving complex scientific and technological subject matter, such as recombinant adeno-associated virus (AAV) vector technology. He has experience representing plaintiffs in patent infringement actions.

Currently an Associate at Marshall, Gerstein & Borun LLP, Mr. Gonzalez previously practiced at McDonnell Boehnen Hulbert & Berghoff. While at McDonnell Boehnen Hulbert & Berghoff, he served as Lead Counsel for Genzyme Corporation in Genzyme Corporation v. Novartis Gene Therapies, Inc., a high-stakes patent infringement case concerning six patents related to AAV vector technology, which underpin products like Novartis's Zolgensma. The case, filed in the District of Delaware, was ultimately dismissed with prejudice via a joint stipulation in February 2024, with each party bearing its own costs.

Mr. Gonzalez also demonstrates experience with post-grant proceedings, having contributed as Amici Curiae in an appeal from the USPTO PTAB to the Federal Circuit concerning In re Cellect, LLC. His publications include commentary on the use of ultra-long patent terms for novel antibiotics and an article on the value of method of treatment patents for repurposed drugs, co-authored during his time at McDonnell Boehnen Hulbert & Berghoff. He was also selected for inclusion in the 2026 edition of The Best Lawyers: Ones to Watch in America™ list for Litigation - Intellectual Property and Litigation - Patent.

Mr. Gonzalez earned his J.D. from the University of Houston Law Center, where he was Editor-in-Chief of The Houston Journal of Health Law & Policy. He holds a Bachelor of Science with a double major in Chemistry and Molecular Biology from the University of Texas at Dallas.
