Dan Smith

Dan Smith is a patent litigation attorney at Haynes and Boone, where he serves as Counsel. His practice primarily involves representing leading technology and consumer electronics companies, notably acting on the petitioner side in Patent Trial and Appeal Board (PTAB) proceedings, seeking to invalidate asserted patents. His client representation is consistently for plaintiffs in tracked cases, reflecting a focus on defending operating companies against patent assertions or enforcing their own intellectual property.

Mr. Smith possesses extensive technical expertise spanning wireless technologies (including 3G, 4G, 5G, Bluetooth, and WiFi standards), video encoding and streaming, medical devices, touchscreen devices and user interfaces, software systems, semiconductors, and optics. His prior experience as a lead software architect and engineer in the telecommunications industry further underpins his deep understanding of these complex technologies.

A significant portion of his practice is dedicated to inter partes review (IPR) and other PTAB proceedings. He has successfully represented clients in more than 150 PTAB trials, earning recognition from Patexia in 2022 and 2023 as one of the top 25 PTAB practitioners and by Managing IP in 2020 as a top lawyer for petitioners at the PTAB. Notable cases in his tracked appearances include representing Apple Inc. as a petitioner in IPRs against MYPORT TECHNOLOGIES Inc. and as counsel in litigation against Avant Location Technologies LLC. The Apple Inc. v. MYPORT TECHNOLOGIES Inc. cases involved patents related to speech and image recognition, while Apple Inc. v. Avant Location Technologies LLC concerned location technology patents.

Mr. Smith is admitted to practice in Texas, before the U.S. Patent and Trademark Office, and the U.S. Court of Appeals for the Federal Circuit. He earned his J.D., cum laude, from Southern Methodist University Dedman School of Law and holds a B.S. in Computer Science from The University of Texas at Austin.
