Colby Alexander Davis

Colby Alexander Davis is a patent litigation attorney with a practice focused on intellectual property and trade secret disputes, including those in the Hatch-Waxman context. His technical expertise spans life sciences, pharmaceuticals, laboratory equipment, and telecommunications. He has a track record of representing plaintiffs, as evidenced by his two tracked appearances exclusively on the plaintiff side.

Currently with Windels Marx, Mr. Davis previously practiced with RuyakCherian (now CHD Law) and other AmLaw 20 and boutique patent litigation firms. He has significant experience litigating in numerous U.S. district courts, including the District of New Jersey, Delaware, Eastern District of Texas, California, and New York, as well as before the Court of Appeals for the Federal Circuit.

Among his notable cases, Mr. Davis served as counsel for Bright Data, Ltd. in Bright Data, Ltd. v. Teso LT, UAB et al. in the Eastern District of Texas. In this case, a jury found infringement and willfulness of Bright Data's patents, awarding the plaintiff $7,474,876.00 in lost profits. He also has experience with post-grant proceedings before the U.S. Patent and Trademark Office's Patent Trial and Appeal Board (PTAB), including Federal Circuit appeals stemming from PTAB decisions, such as a case related to Bright Data, Ltd.

Mr. Davis is admitted to practice in California (2015), the District of Columbia (2022), Tennessee (2020), and before the U.S. Patent and Trademark Office (2023). He earned his J.D., Order of the Coif, from the University of California, Los Angeles - School of Law in 2015, an M.A. from Marian University in 2012, and a B.A., summa cum laude, from Vanderbilt University in 2010.
