Christopher R. Kinkade

Christopher R. Kinkade is an experienced intellectual property attorney currently serving as Of Counsel and Co-Chair of the Intellectual Property Department at Pierson Ferdinand LLP. He offers strategic advice on intellectual property portfolio development, transactions, and litigation. His practice encompasses a broad range of technologies, including the pharmaceutical, biotechnology, medical device, mechanical, and chemical industries, as well as consumer products and services. Kinkade's expertise extends to patents, trademarks, trade secrets, advertising, commercial disputes, contracts, and antitrust matters.

While his tracked appearances include a defendant-side role, Kinkade possesses extensive litigation experience, having been involved in more than 200 federal lawsuits, including jury and bench trials. He is equipped to advise clients on both enforcing and mitigating risk related to intellectual property rights, handling complex claims of patent infringement for both plaintiffs and defendants. His trial experience includes first-chair jury trials in copyright infringement and bench trials in breach of contract and trade dress infringement before the U.S. International Trade Commission. Notably, he represented the defendant in the copyright infringement case ACI Information Group v. MidlevelU, Inc., which proceeded to the Supreme Court petition stage in 2021.

Prior to joining Pierson Ferdinand, Kinkade was with FisherBroyles, LLP from 2020 to 2024 and Fox Rothschild LLP from 2006 to 2020. He is a registered patent attorney with the U.S. Patent and Trademark Office, demonstrating capability in patent prosecution.

Kinkade earned his J.D. from Seton Hall University School of Law in 2007 and a B.S. from the University of Rochester in 2004. He is admitted to practice in New Jersey and New York, as well as before the U.S. Court of Appeals for the Federal Circuit, Second Circuit, Third Circuit, and Eleventh Circuit, and several U.S. District Courts.
