Cary Patterson

Cary Patterson is a founding partner at Nix Patterson, LLP, where he focuses significantly on patent litigation, primarily representing plaintiffs. His practice centers on enforcing intellectual property rights for patent holders, a stance underscored by his two tracked plaintiff-side appearances and no defendant-side roles. The firm frequently undertakes complex commercial and intellectual property matters on a contingency fee basis.

Patterson's patent litigation experience notably includes representing DataTreasury Corporation in its extensive patent enforcement campaign. These cases involved technology related to electronic check processing, image capture, centralized processing, and electronic storage of document and check information. Through these efforts, Nix Patterson recovered over $350 million for DataTreasury, including a $54 million judgment against US Bank for willful patent infringement, which originated from a $27 million jury verdict. The DataTreasury litigation involved numerous defendants across the financial services industry, such as JPMorgan Chase, Bank of America, Wells Fargo, and Fidelity National Information Services.

Beyond district court litigation, Mr. Patterson has experience with administrative patent proceedings. He was involved in DataTreasury Corporation v. Fidelity National Information Services, Inc., an appeal from the U.S. Patent and Trademark Office's Patent Trial and Appeal Board (PTAB) to the Federal Circuit, which affirmed the PTAB's decision. DataTreasury's patents were also subject to re-examination proceedings at the USPTO, where their validity was upheld.

Mr. Patterson earned his Bachelor of Business Administration from the University of Texas at Austin in 1973 and his Juris Doctor from St. Mary's School of Law in San Antonio in 1975. He was admitted to the bar in Arkansas and Texas in 1976.
