Specialty & background

Brian S. Rosenbloom is an experienced intellectual property attorney at Rothwell Figg, specializing in patent litigation, prosecution, and counseling. He possesses a strong technical background in electrical engineering and software, which informs his practice across a broad range of technologies, including telecommunications, wireless networking, Artificial Intelligence (AI) and Machine Learning (ML), video and audio encoding, cloud computing, and ad-serving. His expertise in the AI/ML space is further underscored by his appointment to the Artificial Intelligence/Machine Learning Task Force of the American Bar Association Section of Intellectual Property Law for the 2023-2024 bar year.

Mr. Rosenbloom’s litigation practice encompasses work for both plaintiffs and defendants. He has a track record of both asserting patents against infringers and invalidating patents. His firm, Rothwell Figg (also known as Rothwell, Figg, Ernst & Manbeck, P.C.), is an IP and technology-focused firm based in Washington, D.C.

A notable outcome in his practice includes representing CBS Corporation in Personal Audio LLC v. CBS Corp.. In this "podcasting patent" suit, despite an initial jury verdict of $1.3 million against CBS, the Patent Trial and Appeal Board (PTAB) later found the patent unpatentable in an inter partes review (IPR) proceeding. The Federal Circuit affirmed the PTAB's decision, and the Supreme Court denied certiorari, resulting in the district court vacating the jury's verdict and entering judgment in favor of CBS. He also represented DISH Technologies L.L.C. as plaintiff in a patent litigation against The New York Times Company.

Mr. Rosenbloom actively practices before the U.S. Patent and Trademark Office, including post-grant proceedings before the Patent Trial and Appeal Board (PTAB) and reexaminations. This is further evidenced by his involvement in the successful PTAB invalidation in the Personal Audio case. He earned his J.D. from Georgetown University Law Center in 1997 and holds a B.S. in Electrical Engineering from Columbia University (1990). He is admitted to practice in Maryland (1997), the District of Columbia (1999), and Virginia (2001), as well as before the U.S. Supreme Court and the U.S. Court of Appeals for the Federal Circuit.
