Brian Matty

Brian Matty is a partner at Desmarais LLP, specializing in complex patent litigation across a diverse range of technologies, including diagnostic genetic testing, catheter technologies, robotic surgery, neurostimulation, wireless communications, and media distribution networks. He is also a registered attorney with the U.S. Patent and Trademark Office. Matty's technical background includes being a named inventor on a U.S. patent for a catheter-based medical device used in minimally-invasive heart surgery, which further informs his practice.

Operating out of Desmarais LLP, where he was elevated to partner in January 2023, Mr. Matty's practice demonstrates a balanced approach to patent litigation, representing both patentees and defendants. He was counsel for Molecular Loop's patent licensing program in a recent infringement suit against Illumina and Verinata Health. His notable successes on the plaintiff side include securing a $272.5 million jury verdict, later increased to $372.5 million with enhanced damages, for Ravgen in a prenatal genetic testing patent trial against LabCorp, as well as a $57 million verdict against Natera. He was also a key member of the team that achieved an $82.5 million jury verdict for IBM in a patent infringement trial against Groupon. Prior to joining Desmarais LLP in 2016, Mr. Matty gained experience in patent prosecution and portfolio management as a patent agent and associate at Ropes & Gray.

Mr. Matty possesses extensive experience in post-grant proceedings before the Patent Trial and Appeal Board (PTAB). He served as lead counsel for biotech firm Ravgen, successfully defending its patents against ten inter partes review petitions and securing decisions upholding all challenged claims. He further argued appeals of these IPRs at the Federal Circuit, again achieving decisions affirming the patentability of all Ravgen patents.

He earned his bachelor's and master's degrees in biomedical engineering from the University of Michigan in 2008 and 2009, respectively, and his Juris Doctor from Fordham University School of Law in 2014.
