Brian Buroker

Brian Buroker is a seasoned patent litigator at Gibson, Dunn & Crutcher LLP, specializing in high-stakes intellectual property disputes. His practice encompasses a wide array of technology areas, including mobile devices, electronics, financial services, pharmaceuticals, biotechnology, e-commerce, and software, with a strong background in electrical and computer engineering. He frequently represents clients in matters involving telecommunications technologies such as Wi-Fi, VoIP, and LTE.

Buroker primarily defends operating companies, as indicated by his track record of two defendant-side appearances in internal records. He is noted for developing creative defense strategies aligned with core business priorities. However, he has also served as lead trial and appellate counsel for a patent holder, securing a $31 million willful infringement verdict in Energy Transportation Group, Inc. v. Sonic Innovations, Inc. et al.. Notable defense outcomes include acting as counsel for T-Mobile against Intellectual Ventures, leading to the dismissal of 15 out of 16 asserted patents. In 2025, he was lead trial counsel for Indeed Inc., successfully defeating infringement claims based on patent ineligibility, resulting in four patents being found ineligible on a motion to dismiss. He has also served as lead counsel for Capital One Services, LLC in various patent matters.

Buroker possesses particular expertise in complex, cross-border IPR and PGR proceedings before the Patent Trial and Appeal Board (PTAB). He has achieved significant results as lead IPR counsel, including the invalidation of all challenged claims of three patents for SmaXtec in 2025, and five patents for SharkNinja against Bissell. Also in 2025, he served as lead appellate and IPR counsel for Western Digital/SanDisk, invalidating a patent asserted by Viasat at the PTAB and on appeal at the Federal Circuit. He has argued numerous patent appeals before the Federal Circuit, maintaining a high success rate.

He earned his J.D., magna cum laude, from Georgetown University in 1996, and holds Bachelor of Science degrees, cum laude, in Electrical Engineering and Computer Engineering from North Carolina State University (1992). Buroker is admitted to practice in Virginia and the District of Columbia, as well as before the U.S. Supreme Court, the Federal Circuit, and several U.S. District Courts. He also clerked for the Honorable William C. Bryson on the U.S. Court of Appeals for the Federal Circuit.
