Bita Rahebi

Bita Rahebi is a highly regarded patent litigation attorney and a Vice Chair at Morrison & Foerster, where she also co-chairs the firm's global IP Litigation Group and cross-disciplinary Intellectual Property Group, and co-leads its Semiconductor Industry Group. She has been with Morrison & Foerster since 2000, having started as a summer associate.

Her practice focuses on high-stakes intellectual property disputes, including complex patent, trade secret, and copyright litigation. Rahebi is sought after by innovative technology companies and handles matters across a wide range of technologies, including semiconductors, software, consumer electronics, medical devices, and standard essential patents (SEPs).

Rahebi primarily defends operating companies, with a significant defendant-side preference evident in her tracked case appearances (9 defendant, 2 plaintiff). She has represented major technology clients such as VIZIO, Google, CrowdStrike, Apple, Xilinx, and Nevro Corp. Notably, she was lead counsel for VIZIO in Multimedia Technologies Pte. Ltd. v. VIZIO, Inc. and for Google in Monticello Enterprises LLC v. Google LLC. In the Monticello case, the Federal Circuit affirmed a district court's dismissal, finding the asserted patent claims ineligible under 35 U.S.C. § 101 as directed to an abstract idea. She also secured a victory for Apple against Farstone Technology Inc., invalidating an asserted patent, a decision affirmed by the Federal Circuit. In the medical device sector, Rahebi obtained a preliminary injunction for Nevro Corp. against Stimwave Technologies, Inc., leading to a settlement that included a permanent injunction, and achieved a unanimous precedential Federal Circuit victory preserving foundational patents for high-frequency spinal cord stimulation technology. Her work has been recognized, with four of her cases receiving "Impact Case of the Year" by LMG Life Sciences.

Rahebi possesses extensive trial experience, leading matters before federal and state trial courts, the Federal Circuit, and the U.S. International Trade Commission (ITC). Her experience also includes successful outcomes at the Patent Trial and Appeal Board (PTAB). She is admitted to the State Bar of California (2000) and earned her B.A. from the University of California, Berkeley, and her J.D. from the University of California, Los Angeles, School of Law.
