Specialty & background
Betty Chen is a highly experienced patent litigator currently a partner at Desmarais LLP, based in their San Francisco office, which she joined in October 2023. Prior to Desmarais, she was a principal at Fish & Richardson P.C. from April 2011. Her practice is characterized by a balanced representation of both plaintiffs and defendants in high-stakes intellectual property disputes, including patent infringement, trade secret misappropriation, and Hatch-Waxman cases.
Ms. Chen's expertise spans a wide array of technology sectors, encompassing pharmaceuticals, medical devices, 5G wireless communication infrastructure, software, applications, semiconductors, hardware, and consumer electronics. She possesses deep experience with standard essential patents (SEPs) committed to FRAND terms, particularly within the wireless communication space (5G, WiFi, batteries), and is adept at managing intellectual property diligence and portfolio strategy. Her practice also includes significant experience in post-grant review proceedings, such as inter partes reviews (IPRs).
Throughout her career, Ms. Chen has secured numerous favorable outcomes for her clients. Notable successes include leading the Desmarais team to a significant ITC victory for Sun Pharmaceutical Industries Inc. against Biofrontera, which resulted in limited exclusion orders and cease-and-desist orders against infringing photodynamic therapy systems. While at Fish & Richardson, she obtained a $43 million jury verdict for The Chamberlain Group in a patent infringement case related to garage door openers and a rare general exclusion order (GEO) from the ITC for Skull Shaver, blocking the importation of knock-off electric shavers. She also secured a favorable settlement for DUSA Pharmaceuticals following a preliminary injunction in a medical device trade secret case and represented Adobe Systems Incorporated in successfully defending against patent infringement claims involving Photoshop software, leading to a voluntary dismissal.
Ms. Chen earned her Juris Doctor (J.D.) from The University of Texas Law School in 2006 and her Bachelor of Science (B.S.) from the University of Southern California in 2003. She is admitted to practice in Texas (2006), California (2013), and Washington (2021), and previously clerked for the Honorable Ron Clark in the U.S. District Court for the Eastern District of Texas.
