Aviv Shaul Halpern

Aviv Shaul Halpern is an associate in the Litigation Group at Sullivan & Cromwell LLP, focusing his practice on intellectual property, technology, antitrust, FRAND/SEP, and complex commercial disputes. He possesses significant trial experience, including cross-examining adverse witnesses, and has represented clients in appeals before federal appellate courts. His experience covers a range of technology areas, notably patents related to robotics for storage and retrieval systems and Advanced Audio Coding technology.

Mr. Halpern has demonstrated a preference for representing plaintiffs, with his tracked appearances exclusively on the plaintiff side. A notable engagement includes representing Ocado in multiple IP and antitrust cases against AutoStore, concerning patents on robots used for cubic auto storage and retrieval systems. This representation led to offensive victories, including a complete win in an ITC trial and favorable rulings before the Patent Trial and Appeal Board (PTAB). The matter concluded with a settlement and patent cross-license agreement where AutoStore agreed to pay Ocado over $270 million. He also represented Via Licensing Alliance LLC ("Via LA") in a dispute over a patent license agreement for Advanced Audio Coding technology, reaching a settlement after securing Daubert victories.

His PTAB experience is evidenced by his involvement in securing favorable rulings for Ocado during the dispute with AutoStore.

Mr. Halpern earned his J.D. from the University of Michigan Law School in 2019 and a B.A. from American University in 2012. He is admitted to practice in California.
