Anthony D. Raucci

Anthony D. Raucci is a Special Counsel in the Intellectual Property Litigation practice at Morris, Nichols, Arsht & Tunnell LLP, where he has practiced since joining the firm in 2013. He focuses on patent and trade secret litigation in federal district courts and has been recognized in Best Lawyers: Ones to Watch for intellectual property litigation and patent litigation. With an undergraduate background in nuclear engineering, his technical experience includes work with power utility companies in nuclear power generation facilities.

Raucci's patent litigation experience spans a range of technologies, including pharmaceuticals, medical devices, radio-frequency identification (RFID) systems, oil wells, computer networks, and exhaust gas treatment systems. His tracked case history shows a primary focus on defending operating companies, appearing exclusively on the defendant side in all four documented patent litigation matters, often serving as local or lead counsel.

A significant portion of his practice has involved the multi-party patent infringement litigation series, Midwest Energy Emissions Corp. et al. v. Arthur J. Gallagher & Co. et al. and Midwest Energy Emissions Corp. et al. v. CERT Operations II LLC et al. In these cases, he represented defendants against allegations of infringing patents related to mercury capture technology for coal-fired power plants, serving as lead counsel in one instance and local counsel in others. While a jury in March 2024 awarded Midwest Energy Emissions Corp. $57 million against some remaining defendants in this litigation for willful infringement of mercury emissions technology, Raucci's clients, including Arthur J. Gallagher & Co., had previously reached a settlement in November 2023. He also acted as local counsel for a defendant in Brook & Whittle Ltd. v. CCL Industries, Inc., a case involving patents related to recyclable heat shrink film for containers, which had parallel post-grant review (PGR) proceedings before the Patent Trial and Appeal Board.

Raucci is admitted to practice in Delaware, the U.S. District Court for the District of Delaware, the U.S. Court of Appeals for the Federal Circuit, the U.S. Court of Appeals for the Third Circuit, and before the U.S. Patent and Trademark Office. He earned his B.S. in nuclear engineering from the University of Florida and his J.D. from Washington and Lee University School of Law.
