Andrew R. Sommer

Andrew R. Sommer is a highly experienced patent litigation attorney, co-chair of Greenberg Traurig's Patent Post-Grant Group, focusing his practice on complex intellectual property disputes across a broad spectrum of technologies. His technical expertise spans video and audio coding, optical devices, telecommunications, computer hardware and software, medical devices, pharmaceuticals, and video games. Mr. Sommer advises clients on strategic licensing, patent portfolio development, and patent licensing matters.

He represents both patent owners and accused infringers in various proceedings, including district courts, the International Trade Commission (ITC), and the Federal Circuit. While his tracked appearances include one defendant-side role, his broader litigation record shows representation for both plaintiff and defendant roles.

Mr. Sommer is a Shareholder at Greenberg Traurig, LLP, having joined the firm in May 2019. Prior to this, he was a partner at Winston & Strawn LLP. He is particularly active in post-grant patent proceedings, having appeared in over 100 Patent Trial and Appeal Board (PTAB) trials as first-chair trial counsel. Notably, he was part of the Greenberg Traurig team representing Satco Products, Inc. in successful inter partes review (IPR) decisions where multiple patents were challenged and invalidated at the PTAB.

Before entering private practice, Mr. Sommer served as a patent examiner with the United States Patent and Trademark Office and was one of the first law clerks for the Honorable Kimberly A. Moore of the U.S. Court of Appeals for the Federal Circuit. He earned his J.D., magna cum laude, from George Mason University School of Law and holds a B.S. in Optics from the University of Rochester. He is admitted to practice in Virginia, the District of Columbia, and before the U.S. Patent and Trademark Office.
