Andrew Gish

Andrew Gish is a managing partner at Gish PLLC, specializing in technically complex patent and trade secret litigation across various forums, including federal district courts, the Patent Trial and Appeal Board (PTAB), the International Trade Commission (ITC), and the Federal Circuit. His practice areas are diverse, encompassing technologies such as wireless data transmission, automatic audio/video recognition, networking security, semiconductor manufacturing, microprocessor design, software, blockchain, artificial intelligence, medical devices, and chemical products. Drawing on his background in electrical engineering and prior industry experience at Intel Corporation, Mr. Gish brings a deep technical understanding to high-stakes intellectual property disputes.

Mr. Gish primarily represents defendants, including major corporations and innovative technology companies. His two tracked appearances as lead counsel were on the defendant side in the DISH Technologies, LLC et al. v. A Parent Media Co. Inc. et al. cases, which involve media streaming technology. Before co-founding Gish PLLC, he was a member of the Patent and Technology Litigation group at Skadden, Arps, Slate, Meagher & Flom.

His notable representations include convincing the Federal Circuit to overturn a PTAB decision and adopt Google's dispositive claim construction for 70 patent claims in Google LLC v. Network-1 Technologies, Inc. He also secured a $69 million judgment for JPMorgan Chase in JPMorgan Chase & Co. v. DataTreasury Corp. and obtained summary judgment invalidating all asserted patent claims in Pi-Net International, Inc. v. JPMorgan Chase & Co., effectively ending a plaintiff's patent litigation campaign. More recently, Mr. Gish was part of teams that secured the complete dismissal of a patent infringement lawsuit for Lipotype, invalidating all 20 claims under 35 U.S.C. § 101, and won a dismissal for Zydex based on lack of Article III standing. His experience also extends to IP transactions, such as leading patent asset diligence for The Walt Disney Company's acquisition of Lucasfilm Ltd.

Andrew Gish is actively involved in PTAB and IPR proceedings, a core component of his complex patent litigation practice. He earned his J.D., cum laude, from New York University School of Law in 2010, and holds both an M.S. (2007) and B.S. (2006) in Electrical Engineering, summa cum laude, from the University of Southern California. He is admitted to practice in New York, before the U.S. Patent and Trademark Office, the U.S. Supreme Court, the U.S. Court of Appeals for the Federal Circuit, and the U.S. District Courts for the Southern and Eastern Districts of New York.
