Andrew Dale Gish

Andrew Dale Gish is the Managing Partner of Gish PLLC, specializing in technically complex patent and trade secret litigation across district courts, the Patent Trial and Appeal Board (PTAB), the International Trade Commission, and the Federal Circuit. His practice is informed by an electrical engineering background, including prior experience in microprocessor design and semiconductor manufacturing at Intel Corporation. Before founding Gish PLLC, he practiced in the Patent and Technology Litigation group at Skadden, Arps, Slate, Meagher & Flom.

Mr. Gish handles a broad range of technologies, including wireless data transmission, networking security, RFID, semiconductor manufacturing, microprocessor design, and blockchain, among others. While his practice has included work for both plaintiffs and defendants, with the provided case list showing one plaintiff-side appearance and two defendant-side appearances, he has a notable track record representing defendants in high-stakes intellectual property disputes.

His significant victories include obtaining a $69 million judgment for JPMorgan Chase & Co. in a breach of patent license provision, securing summary judgment invalidating all asserted patent claims against JPMorgan Chase & Co. in a separate matter, and convincing the Federal Circuit to overrule the PTAB and adopt Google's dispositive claim construction for 70 claims across four patents. He currently represents Fortinet, Inc. as defendant's counsel in Skysong Innovations, Inc. v. Fortinet, Inc. in the Eastern District of Texas. Mr. Gish is also active in PTAB proceedings, having represented Fortinet, Inc. as a petitioner in an inter partes review, and his firm has secured Federal Circuit affirmance of PTAB decisions invalidating patent claims.

Mr. Gish earned his J.D., cum laude, from New York University School of Law in 2010, and holds both an M.S. (2007) and B.S. (2006) in Electrical Engineering, summa cum laude, from the University of Southern California. He is admitted to the State Bar of New York, the U.S. Patent and Trademark Office, the U.S. Supreme Court, the U.S. Court of Appeals for the Federal Circuit, and the U.S. District Courts for the Southern and Eastern Districts of New York.
