Andrew D. Wilson

Andrew D. Wilson is a patent litigation partner at Baker Botts L.L.P., based in Washington, D.C., specializing in high-tech patent disputes with a significant emphasis on software-related inventions. His practice areas encompass complex intellectual property issues involving open source and proprietary software, cloud-hosted products (SaaS), distributed software, and machine learning and artificial intelligence systems. Wilson's background as a software developer provides him with a strong technical foundation for developing litigation strategies.

Wilson predominantly represents defendants, including operating companies, in patent infringement actions. His experience includes defending clients against non-practicing entities and competitors in U.S. Federal District Courts, the U.S. International Trade Commission (ITC), and the Patent Trial and Appeal Board (PTAB).

He is actively involved in PTAB proceedings, regularly appearing in inter partes reviews (IPRs) and other post-grant challenges. Notably, he served as lead counsel for DraftKings Inc. in AG 18, LLC v. DRAFTKINGS INC., a case involving streaming technology, where he represented the defendant in district court and related IPR proceedings before the PTAB, leading to a Federal Circuit appeal that largely affirmed the unpatentability of the challenged claims. His PTAB experience also includes representing petitioners challenging patents, such as in Unified Patents Inc. v. GE Video Compression.

Wilson earned his J.D. with honors from George Washington University Law School in 2013. He also holds an M.S. in Computer Science (2010) from George Washington University and a B.S. in Computer Engineering (2007) with a minor in Computer Science from the University of Delaware. He is admitted to practice before the District of Columbia Bar, the Virginia State Bar, the United States Patent and Trademark Office, and several federal courts.
