Amit Makker

Amit Makker is an accomplished patent litigation attorney specializing in complex intellectual property disputes across diverse high-technology sectors. His practice areas encompass networking technologies (both wired and wireless), cellular systems, internet and cloud technologies, semiconductors, computer hardware, medical devices, and automotive industries. He has experience representing clients in district courts, the International Trade Commission (ITC), and before the Patent Trial and Appeal Board (PTAB).

Makker's experience includes both plaintiff and defendant-side representation, though his tracked cases show a strong focus on defending operating companies against patent assertions. He was Lead Counsel for Google LLC in Advanced Coding Technologies LLC v. Google LLC, a case involving video codec and 5G New Radio patents filed by a patent assertion entity, which settled after nearly two years of litigation. In that matter, Google successfully secured the dismissal of pre-suit indirect and willful infringement claims. He also served as Back-up Counsel for Micron Technology, Inc. in its dispute with Yangtze Memory Technologies Co Ltd concerning patents related to 3D NAND flash and DRAM products. Related PTAB proceedings in the Micron case were notably denied after the petitioner failed to identify all real parties in interest, an outcome with significant implications for foreign state-owned entities in PTAB practice.

Currently a partner at Latham & Watkins, Makker has developed a robust practice in patent litigation, building on his prior experience at Sidley Austin. His background as an electrical engineer allows him to effectively distill complex technical concepts for judges and juries. He is admitted to practice in California and before the U.S. Patent and Trademark Office.

Makker earned his J.D. from the University of Southern California Law School in 2011, and holds both an M.S. (2008) and B.S. (2004) in Electrical Engineering from the University of Southern California and the University of California, Los Angeles, respectively.
