Alexander E. Gasser

Alexander E. Gasser is a patent litigation attorney with over twenty-five years of experience, currently serving as a Partner at Skiermont Derby LLP. His practice encompasses a broad range of technologies, including pharmaceuticals (with experience in Hatch-Waxman litigation), biotechnology, semiconductors, LCD technology, natural language processing, and consumer electronics. He focuses on patent litigation in U.S. district courts and advises companies on both asserting their intellectual property rights and mitigating exposure to existing and potential litigation.

Gasser has experience representing plaintiffs in patent infringement disputes, as evidenced by his role as counsel for IPA Technologies in IPA Technologies v. Microsoft Corp. In that case, a jury delivered a $242 million verdict in May 2024 in favor of IPA Technologies against Microsoft, involving patents related to "autonomous electronic agents" and "cooperative task completion," utilized in Microsoft's Cortana virtual assistant. The parties subsequently reached a settlement in June 2024. His prior experience includes working as a senior litigation associate at Oblon Spivak LLP.

He possesses significant experience in post-grant proceedings, having advised clients on inter partes review (IPR) proceedings before the U.S. Patent & Trademark Office and co-authored chapters on IPRs in the treatise "Post-Grant Proceedings Before the Patent Trial and Appeal Board." His firm, Skiermont Derby, has also noted success in IPRs against Google on behalf of IPA Technologies. Gasser has also handled numerous patent interferences, particularly in the chemical and pharmaceutical fields.

Mr. Gasser earned his J.D., cum laude, from Marquette University Law School, where he was an Associate Editor of the Marquette University Law Review, and his B.A. from Cornell University. He is admitted to the State Bar of Wisconsin, the U.S. Patent & Trademark Office, the U.S. Courts of Appeals for the Seventh Circuit and Federal Circuit, and several U.S. District Courts, including the Eastern District of Texas.
