Firm overview

Firm overview. Sideman & Bancroft LLP is a San Francisco–headquartered boutique (not BigLaw) that describes itself as a women-owned, full-service firm operating for more than 40 years. Its IP group — the Brand Integrity & Innovation Group — is a dedicated bench of roughly 18 attorneys plus paraprofessionals. The firm also maintains offices in New York and Paris (Sideman & Bancroft Europe). It is not ranked in AmLaw; its recognitions are IP-specific, including Managing IP's IP STARS (five-plus consecutive years) and a Silver ranking in World Trademark Review's WTR 1000 for trademark enforcement, litigation, and prosecution.

IP litigation specialty. The firm's own materials and rankings show that its litigation center of gravity is brand protection: trademark, copyright, trade-secret, anti-counterfeiting, and DMCA work before federal/state courts, the TTAB, and customs agencies. Clients span technology hardware, telecommunications, electronics, life sciences, consumer products, and fashion. Patent litigation is a comparatively small slice of the practice. The firm's single tracked patent appearance — Red Hat, Inc. v. VirtaMove, Corp. (N.D. Cal., No. 5:24-cv-04740) — concerned software patents covering containerization/container-orchestration technology (Docker/Kubernetes/OpenShift), a matter in which the firm acted strictly as local counsel for the defendant.

Side preference. The available data skews defense-side: in the one tracked appearance, Sideman & Bancroft appeared for the defendant (VirtaMove, the patent owner resisting Red Hat's declaratory-judgment action). Given that the firm's substantive IP docket is dominated by enforcement of brand owners' trademark/copyright/trade-secret rights, it does not fit the pattern of a plaintiff-side NPE or PAE firm; its role in the tracked patent case was localized support for an operating company's lead trial counsel (Russ August & Kabat). A general "both sides" characterization is not reliably supportable from public sources given the thin patent docket.

Notable cases or outcomes. Red Hat, Inc. v. VirtaMove, Corp. is the tracked matter. Red Hat sought a declaration of non-infringement of two VirtaMove patents, arguing it was "imminently threatened" because VirtaMove had sued Amazon, Google, IBM, HPE, and others over Docker/Kubernetes technology. The firm's client prevailed on a Rule 12(b)(1) motion: Judge P. Casey Pitts dismissed the complaint for lack of an Article III case or controversy, holding VirtaMove had taken no affirmative act directed at Red Hat, and denied Red Hat's motion to amend as futile. The case closed in April 2025. No Federal Circuit appeal was identified in the sources reviewed.

PTAB/IPR practice. There is no public evidence of a notable PTAB/IPR filing or defense practice. The firm's administrative-bodies experience, as described on its site and in rankings, centers on the TTAB rather than the PTAB; any IPR work would be incidental. Key IP partners. Richard J. Nelson and Jeffrey C. Hallam (Hallam also serves as Managing Partner) co-chair the Brand Integrity & Innovation Group; Kelly P. McCarthy chairs the trademark practice; and Zachary Alinder is the firm's most prominently ranked IP litigator (WTR 1000, IP STARS). John van Loben Sels recently joined as a partner with patent-infringement and trade-secret trial experience. Notably, none of the firm's ranked IP stars is a patent litigator, and Eugene M. Pak — the attorney on the tracked Red Hat appearance — does not appear in the firm's public IP rankings, consistent with a local-counsel role.
