DivX sued Netflix in 2019 alleging infringement of the '588 patent. The case was stayed for about 3.5 years pending IPRs and appeals; after trial in March 2026, the final judgment found Netflix did not infringe several other DivX patents and held others invalid, and the '588 patent did not appear in the trial verdict/final judgment.

DivX asserted claims 1–5 and 12 of U.S. 9,270,720 against Hulu as one of the patents-in-suit in Hulu I. The action was dismissed on August 25, 2022 before trial.

Netflix and Hulu petitioned for inter partes review of claims 1–5 and 12 of U.S. 9,270,720. The Board instituted review and issued a final written decision on September 27, 2021 finding no challenged claims unpatentable.
