VirnetX and SAIC sued Microsoft for infringement; jury found willful infringement and awarded $105.75 million in March 2010; case resolved by stipulated order of dismissal with prejudice on June 1, 2010 (settlement).
VirnetX's case against multiple defendants; the '759 patent was part of the patent set. First Apple trial resulted in a ~$368M willful-infringement verdict. On appeal, VirnetX I, 767 F.3d 1308 (Fed. Cir. 2014), affirmed validity and VPN-on-Demand infringement, vacated FaceTime infringement and damages, and remanded. The Cisco portion ended with a Cisco non-infringement verdict.
Inter partes reexamination of the '759 patent with Cisco Systems as third-party requester. The USPTO issued a closing action rejecting claims 1, 3–10, 12–16, 18–25, and 27–30 and confirming claims 2, 11, 17, and 26.
VirnetX's appeal of the PTAB's invalidity findings in inter partes reexamination 95/001,746 involving the '759 patent. Oral argument was Jan. 8, 2020; the Federal Circuit issued a Rule 36 judgment affirming the PTAB on Jan. 21, 2020.
VirnetX and SAIC asserted patents against Apple over iPhone 5, iPod touch 5th gen., iPad 4th gen., iPad mini, and then-current Macs. The case was consolidated with 6:11-cv-00563 and later amended to add 8,051,181 and 8,504,697. It produced the 2016 retrial on the '504/'211 patents and the April 2018 trial on the '135/'759/'180/'151 patents; further post-trial/appellate proceedings continued into the 2020s.
