NSI sued NeoPath for patent infringement, unfair competition, and false advertising; by amended complaint, only patent infringement remained. On preliminary injunction, NSI relied on claim 19 of US 4,965,725 and claim 24 of US 5,287,272; the S.D.N.Y. denied the motion in May 1998. After NSI filed Chapter 11 in March 1999, the case was removed from the active docket and later terminated as part of an IP acquisition, with no merits judgment on the '725 patent.
