DuPont filed a declaratory judgment action against Cetus challenging the validity of the PCR process patents. On February 27, 1991, the federal district court in San Francisco ruled in Cetus's favor, holding the patents valid and DuPont not to infringe; DuPont reportedly did not appeal.
Direct-purchaser class action alleging Walker Process antitrust claims against Roche and Applera over the Taq polymerase patent. The court's 2005 opinion named US 4,683,195 and US 4,683,202 as related Roche PCR patents; the case later settled in 2008 for $33 million.
Roche sued Promega for infringement of US 4,889,818 and breach of the Cetus–Promega license agreement covering Roche's PCR process patents. The district court found the '818 patent unenforceable for inequitable conduct; the Federal Circuit vacated in part and remanded, and on remand the district court again held the patent unenforceable.
