He notably represented Toyota Motor North America, Inc. as a defendant in the Emerging Automotive LLC v. Toyota Motor North America, Inc. et al. patent litigation, which involved digital key technology and included related inter partes review proceedings.

McCutcheon is also active in post-grant proceedings, with "Inter Partes Reviews (IPRs)" listed as a focus area. He has appeared as patent owner counsel in IPR proceedings, such as IPR2018-00268.
